Occasionally in Germany it is actually claimed, sometimes even by the police, that the singing of all three verses of the German national anthem is forbidden because it violates § 86a of the Penal Code (StGB). The District Court of Lüneburg ruled in a judgment (Az. NZS 15 Gs 419/03) includig: "The 'Song of the Germans' (the German national anthem) does not represent a hallmark of an unconstitutional organization, but is the German national anthem, i.e. a national symbol, which is explicitly placed under protection against vilificationis, stated in § 90a Abs. 1 Ziff. 2 StGB. Nor does the text of the 1st verse be subject to the provisions of § 86a of the StGB. It should be recognised, so the court went on, that only the third verse of the national anthem should to be sung on public occasions. "Whith that, the rest of the text of the anthem is never to see as prohibited or even be regarded as prohibited or even classified as a hallmark of an unconstitutional organisation. (...) Admittedly, the court is surprised that, according to the assessment of the police in Germany, the singing of one's own national anthem is obviously regarded as a criminal offence ..."
